Personal data is only collected on our websites if you provide us with this information, e.g. in order to register for personalized services such as a 1-2-1 session where you need to provide your name, phone number and email address.
To use the services and features of our app you need to tell us who you are and create a customer account. We only collect and process the information that you give us. This includes your name, address, email address and password. For when you are ordering products or services on our app, you can provide your phone number and delivery address in your customer account. Please note that for personalised photo gifting products and to book family portrait photography sessions our app directs you to the https://photoshop.fujifilm-houseofphotography.com/ website and https://portraits.fujifilm-houseofphotography.com/ website respectively and no transactions for those products or services take place in the app.
When using some of our websites or a kiosk you may create an account (and you will be required to do so in certain circumstances (e.g. if you order any product on-line or a product on a kiosk which is not capable of being produced in-store). We collect and process the information that is required when you create an account. This may include first and last name, phone number, email address, password, images and, only if specifically requested by you to be included in or on a photo product, personal life data (e.g. date of birth, age, sex, nationality). For when you are ordering products or services (other than any camera hire and/or bookings for the House of Photography studio or workshops – see External Links section below) from our websites, you can provide your address, including billing and delivery address in your customer account.
We process the personal data based on your consent, for the performance of a contract or as necessary for the purposes of our legitimate interests, including for responding to your enquiries, ensuring that your photo product is correctly produced and delivered and to customize and improve our web/app/kiosk offerings, products and services in accordance with your preferences (Art. 6 (1) (a), (b) and (f) GDPR).
Furthermore, in connection with the personalized services we are entitled to process and use that personal data for advertising and market research purposes or for personalised provision of services if you have given your consent. If you give your consent the information accessed by you whilst visiting our websites, using our app or creating an account on our websites or a kiosk, can be stored in a user profile in order to be able to offer you information specifically personalised for you (e.g. in the form of a newsletter or other marketing communication). You can withdraw your consent at any time with effect for the future.
If you use personalised services such as ordering a product we will use your personal data required for the provision of the services and thereafter for as long as required or permitted under applicable laws. We share your data with affiliated FUJIFILM companies if this is necessary to respond to your enquiries or if necessary for the provision of the services. We may forward enquiries regarding our products and services also to a distributor that is responsible for the relevant product or service category and region.
We may use vendors and/or service providers to assist us with the provision of some of our services to you. All such third parties are subject to strict contractual obligations to comply with our instructions and applicable data protection laws as our processor.
We collect personal data that you provide to us when contacting us, when registering for a customer account in connection with the use of our websites, app and/or kiosks or when ordering products. The type of data we collect is obvious from the data input fields and upload features used on our websites, app and/or kiosks. We use the non-financial information provided by you when ordering through our app or our kiosks to ensure that your photo product is correctly produced and delivered and to respond to other enquiries. The data we collect relating to your order will be retained for a short period in case of queries and thereafter only to the extent permitted or required by law.
We use the information provided by you when ordering through our websites to process your order and to respond to other enquiries. After complete fulfilment of the contract for your order, your data will be stored until expiry of the statutory retention periods under applicable tax and trade laws.
Your personal data will only be used for other purposes if you have given your consent to the use of your personal data, if we are authorised or required to use your personal data for regulatory purposes, or if we reserved the right to use your personal data in accordance with applicable laws and as further described below.
We employ third parties to produce certain goods or services ordered through our websites, app and/or kiosks and transfer data necessary for any such product to the relevant third party. Such third party will be subject to strict contractual obligations to comply with our instructions and applicable data protection laws as our processor. We also transfer certain of your data to the carrier chosen for delivery to the extent necessary for delivery of goods to you or to the third party designated by you.
When you register for a FUJIFILM House of Photography customer account on our app we usually collect name, address, e-mail address and password.
When you register for a customer account on our websites or one of our kiosks we usually collect name, address, phone number, email address and a password.
On our websites when ordering products and/or services (other than any camera hire and/or bookings for the House of Photography studio or workshops – see External Links section below) you will need to provide your address, including billing and delivery address.
To receive our newsletters or other marketing communications, you must enter your e-mail address; we also collect and use information regarding your newsletter/other marketing communication confirmation and the use of our information services. We might also collect information about the quality and success of our e-mail marketing (e.g. by analysing the opening or click rates of our e-mails). In order to provide you with personalised offers and information, we might use your interactions with us (e.g. your purchase history (if any)) to analyse which offers could be of interest for you. In connection with our customer services we might collect and use further information regarding your enquiries you might have and our handling thereof, including any related correspondence.
If you have created a customer account on any of our websites, our app or on one of our kiosks or any of these, we store your data for each customer account for as long as you maintain that customer account. You may have any of your customer accounts deleted at any time; please send us a message to firstname.lastname@example.org.
In the event of deletion of any such customer account, we store the relevant data only to the extent necessary to fulfil a contract or to the extent permitted or required by law.
With any of your customer accounts, you can administer your contact data and, if relevant for that account, view your current and past orders (as applicable). Please treat your access data as confidential and do not share any of your passwords with any third parties. We are not liable for any abuse of your passwords, unless caused by us. As long as you do not sign out you will stay logged in on our websites, app, or kiosk. This allows you to use our websites, app or kiosk and the various functions without having to log in again. If you wish to change your personal information or place an order, you will be asked to enter your password again. Please close any web browser you used to login (desktop or mobile), kiosk sign in screen, or the app at the end of the session, especially if a third party can have access to your computer or mobile device, or our kiosk. If you become aware of, or if you suspect that a third party has obtained unauthorized access to your access data or used your account, please change your passwords without undue delay and inform us by e-mail.
For the performance of our contractual obligations, we may employ a third party to produce the ordered goods or services on our behalf and transfer data necessary for any such product or service to the third party. Such third party will be subject to strict contractual obligations to comply with our instructions and applicable data protection laws as our processor. We also transfer certain of your data to the carrier chosen for delivery to the extent necessary for delivery of goods to you or to the third party designated by you.
When using our websites (including when you are directed from our app to our personalised photo gifting website or our family portrait photography website) to order goods and/or services and depending on the payment service selected during the ordering process, we will also transfer certain of your personal data to the provider of such payment service (“Payment Provider”) to the extent necessary for payment processing.
We do not perform a credit check ourselves and do not use any own credit scoring. However, credit checks and scoring can be performed by the Payment Provider selected during the ordering process. For the processing of the payments the respective contractual terms of the Payment Provider and their data protection terms apply.
Any transfer of your personal data to authorities will only occur in accordance with mandatory laws.
Data usage when registering for e-mail newsletters
If you subscribe to our newsletters or to receive other marketing communications, we will use the personal data necessary or separately provided by you to send you our e-mail newsletter or other marketing communication as agreed. Our app offers both Facebook and Twitter social media plugins to enable logins in the app. Our kiosks offer various social media plugins to enable logins on the kiosk. We do not capture or store these personal social media login credentials.
If when using our Photo Shop website, you access your images on Google Photo, your data used may include:
- Information about the apps, browsers and devices you use to access their services;
- Information about your activity whilst using their services;
- Information about your location;
At FUJIFILM we take adequate technical and organizational security measures in order to protect your personal data from being misused and to prevent the loss of your data. Your personal data is saved in a secure operating environment that is not accessible to the public. All personal data provided by you in the course of registration or use of personalised services will be transferred in encrypted form in order to prevent misuse of the data by any third party.
Use by us of FUJIFILM group companies or other third parties to assist us in providing goods and/or services to you may mean that your personal information is processed outside of the EU/EEA.
